Abstract

Cybercrime has become a fast-growing challenge for law enforcement systems, especially in the context of the growing presence of cyber technology, financial services, social media, artificial intelligence, and cryptocurrencies in everyday social and economic activity. The article throws light on the key issues and opportunities in cybercrime law enforcement in Pakistan, highlighting the legal, institutional, technological, evidentiary, and constitutional dimensions of the problem. It discusses the history of cybercrime and Pakistan's legal efforts, including the Prevention of Electronic Crimes Act 2000 and the institutional changes brought in by the amended amendments in 2025. Investigation and digital forensics, electronic evidence, prosecution, adjudication, privacy and fundamental rights in the cybercrime justice process are discussed. Emphasis is placed on issues such as encryption, anonymization, cross-border crime, inadequate technical resources, institutional complexities, under-reporting, evidentiary problems, and delays in prosecution. The article also looks at international collaboration and new risks linked to AI, deepfakes, ransomware, criminal activity involving cryptocurrencies, and mass data breaches. It believes there is a need for more than legislation to control cybercrime effectively. Technically competent institutions, specialized investigators and prosecutors, judicial skills, robust digital forensic capabilities, inter-agency coordination, international cooperation, robust legal frameworks, robust data protection, and privacy and freedom of expression protection are all essential to sustainable enforcement. The article concludes that Pakistan's future cybercrime strategy should focus on a rights-based, technologically informed, victim-centered, and integrated approach.
